1. Definitions
In these Terms of Service ("Terms"): "Service" means the swattedw.tf website, dashboards, and APIs; "User" or "you" means any individual or entity using the Service; "Lookup Inputs" means identifiers or data you submit for searches; "Results" means outputs returned by the Service; "Query Metadata" means limited technical data about a lookup (for example timestamp, module name, rate-limit outcome, and request identifiers) and does not include full query content; and "Consumer" means a user acting outside their trade, business, or profession.
2. Acceptance, Eligibility, and Account Security
By accessing or using the Service, you agree to these Terms and our Privacy Policy. You must be at least 16 years old to use the Service, or older where local law requires a higher age. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3. Service Description, Availability, and Beta Features
The Service provides OSINT/lookup tools for legitimate research and security purposes. We may modify, suspend, or discontinue features at any time. Some features may be marked as beta or experimental and are provided "as is" without any service level commitment.
4. Acceptable Use and Prohibited Conduct
You may use the Service only for lawful purposes and with a valid legal basis. You must not, and you must not help others to:
- Engage in doxxing, harassment, stalking, intimidation, extortion, blackmail, or swatting facilitation
- Impersonate any person or entity, or engage in identity fraud
- Discriminate, threaten, or target individuals based on protected characteristics
- Conduct unlawful surveillance, tracking, or monitoring
- Submit data you do not have a lawful basis to process
- Bypass rate limits, access controls, or security measures
- Reverse engineer, decompile, or attempt to extract source code or data sets
- Resell or redistribute Results without written authorization
- Use automated scraping or bulk harvesting that degrades the Service
We actively monitor for exploitation attempts (such as vulnerability scanning, injection payloads, and unauthorized access probes). Attempted attacks may be logged, automatically blocked, and may result in suspension or termination.
5. User Responsibilities for Lookup Inputs and Results
You are responsible for ensuring that you have a lawful basis to submit Lookup Inputs and to use Results. Public availability does not mean lawful use. Results may be inaccurate, incomplete, or outdated, and you must verify information before taking action or making decisions.
You are solely responsible for any misuse of the Service or Results. To the maximum extent permitted by law, swattedw.tf is not liable for claims, damages, or legal consequences arising from your unlawful or abusive use of the Service.
6. API Use
If you use our APIs, you must comply with published rate limits, keep API credentials secure, and use the APIs only for authorized purposes.
7. Fees, Billing, and Refunds
Paid plans, if offered, are billed according to the plan description shown at purchase. Except where required by law, all payments are final and non-refundable, including for unused time, usage, or credits. Chargebacks or payment reversals may result in immediate suspension.
8. Suspension, Termination, and Abuse Reporting
We may suspend or terminate access immediately for violations of these Terms, suspected abuse, fraud, or legal risk. We may preserve evidence, restrict access, and cooperate with law enforcement or regulators where required or appropriate. Accounts terminated for violations are not eligible for refunds, except where required by law.
9. Intellectual Property
The Service, its design, and original content are owned by swattedw.tf or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service.
10. Copyright/DMCA Notice and Takedown
If you believe content on the Service infringes your copyright, submit a notice to our designated agent at legal@swattedw.tf. Notices must include the information required by 17 U.S.C. 512(c)(3).
11. Disclaimers
To the maximum extent permitted by law, the Service and Results are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, or non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, swattedw.tf will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. This limitation does not exclude liability that cannot be excluded by law (including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or willful misconduct). If you are a Consumer, your mandatory statutory rights are not affected.
13. Indemnification
You agree to indemnify and hold swattedw.tf harmless from claims arising out of your use of the Service, your Lookup Inputs, or your violation of these Terms or applicable law.
14. Privacy
Our Privacy Policy explains how we process personal data, including roles for user-submitted Lookup Inputs and Service logs.
15. Changes to the Service or Terms
We may update the Service or these Terms from time to time. We will post the updated Terms on this page and change the "Last Updated" date. Material changes may also be communicated by email or in-product notice where feasible.
16. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or successor in connection with a merger, acquisition, or sale of assets.
17. Force Majeure
We are not liable for delays or failures caused by events beyond reasonable control, including outages, third-party provider failures, or acts of government.
18. Severability
If any provision is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules. The courts located in Delaware have non-exclusive jurisdiction for disputes. If you are a Consumer habitually resident in the EU/EEA/UK, you may also bring proceedings in your country of residence, and mandatory consumer protection laws of your country apply.
